E-Bike Classes 1, 2 and 3 Explained: Throttle, Speed Caps and Where You Can Ride

Class 1 is pedal-assist only, no throttle, assist cuts out at 20 mph. Class 2 has a throttle that can propel the bike on its own, also capped at 20 mph. Class 3 is pedal-assist to 28 mph and must have a speedometer. Those are the definitions in the model state law summarised by the National Conference of State Legislatures, which counts 26 states as having adopted the three-class framework. Separately, federal consumer-product law defines a low-speed electric bicycle as a two- or three-wheeled vehicle with working pedals and a motor under 750 watts that cannot exceed 20 mph on motor power alone. The two rules are not the same thing, and only your state's version controls where you may ride.

The three classes side by side

Class 1Pedal assist only. No throttle. Assist stops at 20 mph. Widest access to bike paths and multi-use trails.
Class 2Throttle can move the bike with no pedalling. Motor stops assisting at 20 mph. Usually allowed wherever Class 1 is, but some agencies exclude throttles from natural-surface trails.
Class 3Pedal assist to 28 mph, speedometer required. Most restricted: several states add minimum ages and helmet rules, and often bar Class 3 from shared paths.

NCSL quotes the Class 3 definition as a bicycle whose motor "ceases to provide assistance when the bicycle reaches the speed of 28 miles per hour and is equipped with a speedometer." A bike is not Class 3 just because it goes fast — the speedometer and the assist cutoff are part of the definition.

Federal law is a product rule, not a traffic rule

15 U.S.C. § 2085 defines a low-speed electric bicycle as "a two- or three-wheeled vehicle with fully operable pedals and an electric motor of less than 750 watts (1 h.p.), whose maximum speed on a paved level surface, when powered solely by such a motor while ridden by an operator who weighs 170 pounds, is less than 20 mph." That statute governs how the Consumer Product Safety Commission regulates the product — it decides whether something is sold as a bicycle or as a motor vehicle. It does not tell you which path you can ride on. Note the three details people miss: the motor test is motor alone (not pedalling plus motor), the test rider is assumed to weigh 170 pounds, and the definition explicitly includes three-wheeled machines, so electric trikes fall inside it.

Throttle vs pedal assist — what actually changes on the road

Pedal assist reads either your cadence (are the cranks turning?) or your torque (how hard are you pushing?) and adds power proportionally. A throttle bypasses your legs entirely. The practical differences: a throttle gets you moving from a dead stop on a hill or at a light with a load on board, which is why the cargo and trike listings lean on it; pedal assist with a torque sensor feels like a stronger version of your own effort and uses less battery per mile. In the Volt Ranger catalog, the listings that specifically name a torque sensor are the Mooncool TK Pro trike and the Kingbull Verve and Trekker; Kingbull also sells a torque sensor bottom bracket as a $49 part. The Kingbull Ranger listing states it offers "pedal assist and throttle support."

The speed-unlocking parts are a legal trap

This is the most important thing in the catalog that nobody writes about. Kingbull sells Speed Program Modifier accessories ($40–$49) for the Discover 2.0, Rover 2.0, Trekker, Verve, Voyager 2.0, Jumper Go and EX Titan, described as removing "throttle speed limits, enabling speeds up to 28 mph." There is also a Speed Upgrade Controller for the Literider 2.0 ($59, up to 28 mph) and one for the Hunter 2.0 ($39, described as enabling 32–35 mph). A throttle that drives the bike past 20 mph does not fit any of the three class definitions. Fitting one of these can take the bike outside what your state recognises as an electric bicycle, and outside what your insurer and the manufacturer's warranty assume. Read your state statute before you buy one, not after.

What the catalog does and does not tell you

Across the 671 listing rows in the two feeds we track, no product description states a class number. Only two performance figures appear at all: the Rover 2.0 listing says it can "hit speeds up to 28 mph," and the Verve listing quotes a 750W Bafang motor with a 1400W peak. So do not assume a class from a spec sheet on a retail page — confirm it from the manufacturer's own compliance label or manual, which is where the class sticker legally belongs in states that require one. If your riding is mostly on shared paths, a bike you can run in a 20 mph pedal-assist mode is the safe default.

Before you ride anywhere new

Three checks, in order. One: look up your own state's vehicle code — NCSL notes at least 25 states mandate helmets for some or all e-bike riders, and several set minimum ages for Class 3. Two: check the land manager, not just the state. A state can permit Class 1 on bike paths while a county park, a national forest district or a beachfront town bans throttles outright. Three: if you are on a trike, confirm width rules; many paved trails have bollards or gates sized for two-wheelers. Rules change every legislative session, so treat anything you read — here included — as a starting point rather than a citation.

Is a 750W e-bike legal?

Federal law defines a low-speed electric bicycle as having a motor of less than 750 watts, and many 750W-rated bikes are sold as e-bikes. But wattage ratings are marketing-loose, states set their own limits, and some states cap motor output separately from the class system. Check your state statute rather than assuming.

Does a throttle automatically make it Class 2?

Only if the motor stops assisting at 20 mph. A throttle that keeps pulling past 20 mph does not match any of the three class definitions, which is why the speed-unlocking accessories in this catalog deserve caution.

Are electric trikes covered by the class system?
